This Privacy Policy will explain how we process your Personal Information/ Personal Data, how we collect it, what is the purpose of collection and what rights you have in relation to your Personal Information/ Personal Data.
The term ‘You’ or ‘Your’ refer to you as the user (registered or unregistered) of the Recovery App. You means a person who is availing the services of the Recovery App and whose Personal Information is collected or processed.
The Company is committed to respecting the privacy of every person who shares their Personal Information/ Personal Data with Us or whose information is received by Us. Your privacy is of utmost importance to Us and We strive to take care and protect the Personal Information/Personal Data, We receive from You to the best of Our ability.
This Privacy Policy (“Privacy Policy”) applies to the collection, storage, use, processing, disclosure and transfer of Your Personal Information/ Personal Data (defined below) when You use or visit the Recovery App.
This Privacy Policy is in compliance with all the relevant privacy laws including Information Technology Act, 2000, Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011 and Digital Personal Data Protection Act, 2023.
In this Privacy Policy, references to:
a) Clinician means a registered provider of health care treatment and advice with suitable training and experience in pre- and post-operative care such as a surgeon, medical practitioner, physiotherapist or other healthcare professional.
b) Recovery App means the mobile application called Recovery App, created by the Company, that can be downloaded for use on mobile devices.
c) Personal Information/Personal Data means information about an individual who can be identified or is reasonably identifiable including but not limited to information about a person’s racial or ethnic origin, sexual orientation, which is also Personal Information. Personal Information/ Data information also includes an individual’s health information, genetic information (which is not otherwise health information) and biometric information. The words Personal Data or Personal Information are used interchangeably in this Privacy Policy. The types of Personal Information/ Personal Data that is collected have been elaborated under Paragraph 3.
d) Processing (including its grammatical variations) means performing any automated operations including collection, recording, organizing, structuring, indexing, sharing, storage, adaptation and would also include analytics done by Us to provide You related services.
a) By accessing the Recovery App or by clicking “I Agree” to the Privacy Notice [insert link of Privacy Notice] or by providing Us with Your Personal Information Yourself or by making use of the Services provided through the Recovery App, You have consented to the processing of Your Personal Information in accordance with the provisions of this Privacy Policy and Privacy Notice.
b) You acknowledge that You are providing Your Personal Information in free, informed and unconditional manner. Where You are providing information about another User, You hereby confirm that you are authorized to provide such information to Us.
c) Further, You hereby acknowledge that the collection/receipt of your Personal Information by the Company is necessary for the specific purposes identified under Paragraph 5. You hereby give Your consent that the collection, receipt, storage, processing, use, and disclosure any Personal Information, if it is done in accordance with the provisions of this Privacy Policy and privacy Notice, shall not cause any wrongful loss or damage to You.
You have the option not to provide Us the Personal Information sought to be collected. You will also have an option to withdraw Your consent at any point by intimating Us in writing or clicking “I Withdraw my consent ” in the Privacy Notice. Please note that if You do not provide Us Your Personal Information or if You withdraw the consent to provide Us Personal Information at any point in time, We may not be able to fulfil the purposes for which the said Personal Information was sought and We may restrict You from using the Application or Services or any part thereof.
The kinds of information that We collect about You include but are not limited to the following:
a) Patient/caregiver/doctor/health care professional name;
b) Birth date/age;
c) Gender;
d) Address (including country and pin/postal code);
e) Phone number/mobile number;
f) Email address;
g) Physical, physiological and mental health condition, provided
by You and/or Your health care professional or accessible from
Your medical records, personal medical records and history;
h) Valid financial information at time of purchase of
product/Services and/or online payment;
i) Recovery App Login ID and password;
j) User details as provided at the time of registration or
thereafter;
k) Records of interaction with Recovery App representatives;
l) Your usage details such as time, frequency, duration and
pattern of use, features used and the amount of storage used;
m) Master and transaction data and other data stored in Your user
account;
n) Internet Protocol address, browser type, browser language,
referring URL, files accessed, errors generated, time zone,
operating system and other visitor details collected in Our log
files.
o) User’s tracking Information such as, but not limited to the
device ID, Google Advertising ID and Android ID;
p) Any other information that is willingly shared by You.
q) health information and records relating to orthopaedic surgery,
prehabilitation and post-operative recovery.
Health information and records are Personal Data. Where you have provided us with consent, the health data automatically collected on your device by the Apple Health App or the Google Fit App will be accessed by the Recovery App.
a) Personal Information will be collected from you when you download the Recovery App, when you upload information to the Recovery App and when we communicate with you by other means in relation to your use of the Recovery App. If you consent, the health data automatically collected on your device by the Apple Health App or the Google Fit App will be accessed by the Recovery App. We may also collect personal information about you from Clinicians when they upload information about you to the Recovery App. We use data for analytics and measurement to understand how our services are used. For example, we analyze data about your visits to do things like optimize product design.
b) We do not collect your Personal Information unless you have provided CONSENT through the Privacy Notice [Insert link of Privacy Notice] or we are otherwise permitted to do so under applicable privacy laws.
c) The information that we collect may be processed and stored by a third-party service provider (such as Google Cloud and may be combined with or linked to other information held about you).
d) We retain a record of Personal Information about all individuals with whom we deal. Once the purpose for which the Personal Information has been collected is complete and does not require that Personal Information, we erase the Personal Information within reasonable time.
e) If the information is no longer required by us for any purpose for which it may be used or disclosed and is no longer required by law to be retained by us, we will delete, destroy or de-identify the information.
Can I remain anonymous?
You generally have the right not to identify yourself when dealing with us where it is lawful and practicable for us to allow it. However, given the nature of the Recovery App, you will not be able to use the Recovery App while remaining anonymous.
Your personal information (including your Personal Information is collected, held, used and disclosed for the following purposes:
a) to enable you to access and use the Recovery App to track and monitor your recovery and manage treatment, in conjunction with a Clinician;
b) to operate, improve and optimize the Recovery App;
c) to send service, support and administrative messages, reminders, technical notices, updates, security alerts and information;
d) to report to any other Clinician that you have chosen and identified and are involved in your care; and
e) to comply with our legal obligations.
f) We may also use information, which has been de-identified (so that it cannot be used to identify you) and anonymized for the following purposes:
g) for data analytics to study the use of and improve the Recovery App; our services and technology; patient care and treatment; and
h) for research purposes including for use in clinical studies, presentations at conferences and publication in medical journals.
Your Personal Information may be disclosed to the following third parties for the purposes listed above:
a) Clinicians for the purposes of managing treatment and interacting with patients using the Recovery App.
b) third parties you have authorized, such as your carer or next-of-kin.
Health data automatically collected on your device by the Apple Health App or the Google Fit App will be accessed by the Recovery App (if you consent) and disclosed to your Clinician.
When we disclose Personal Information to third parties, we take all reasonable efforts to ensure that we disclose only relevant information that is accurate, complete and up-to-date and that the third party will comply with the relevant privacy laws mentioned above and applies adequate security standards in relation to your Personal Information.
Your Personal Information may be disclosed in other circumstances where you have consented to the disclosure, or where we are expressly permitted to do so by the Privacy Act or other legislation.
These other disclosures may include where:
a) you would reasonably expect the disclosure to occur (for example, quality assurance purposes or training);
b) compelled by law to disclose;
c) it will prevent or lessen a serious threat to someone's life, health or safety or a threat to public health or safety;
d) it is necessary as part of the establishment or defense of a legal claim;
e) it is requested by an enforcement agency such as the police; or
f) it is a necessary part of an investigation following a complaint or incident.
We may disclose data which has been de-identified to recipients outside India for data analytics and research purposes.
a) The security of your Personal Information is important to Us. We have adopted reasonable security practices and procedures including role-based access, secure communication, password protection, encryption etc. to ensure that the Personal Information collected is secure. You agree that such measures are secure and adequate. We may allow access to Your Personal Information to Our and Our affiliates’ employees, agents, third party service providers, partners, and agencies who need to know such Personal Information in relation to the Purposes as specified above in this Privacy Policy and provided that such entities agree to abide by this Privacy Policy.
b) While We will endeavor to take all reasonable and appropriate steps to keep secure any information that We hold about You and prevent unauthorized access. You acknowledge that the internet is not 100% secure and that We cannot provide any absolute assurance regarding the security of Your Personal Information.
c) The Personal Information we collect from individuals is, depending on your location, held and stored on secure third-party servers in Australia and India.
a) If you wish to see what information is held about you, you can ask for a copy of it. Sometimes it may not be possible to give you a copy of the information if it was provided anonymously, if it contains details about other people, or if it would be unsafe to provide the information (for instance, if it may lead to harm being done to another person).

Our Recovery App does not offer products and Services for children/minors. If You are below the age of 18 years, please use our Recovery App only in the presence of a parent or guardian.
a) If you have a complaint or concern regarding the handling of your Personal Information or think that your privacy has been affected you should contact us as detailed below for an examination of your complaint or concern.
b) Your complaint will first be considered to determine whether there are simple or immediate steps which can be taken to resolve the complaint.
c) Your complaint will then be investigated. You may be asked to provide further information about your complaint and the outcome you are seeking. We will then typically gather relevant facts, locate and review relevant documents and speak with individuals involved.
